04/16/2009— Gavin Tighe and James Cook score a significant victory for Ontario real estate lawyers and their insurance company
Gavin Tighe and James Cook scored a significant victory for Ontario real estate lawyers and their insurance company. In this case, Stewart Title (a real estate title insurer) was trying hard not to pay the costs of defending a lawyer accused of negligence in a real estate deal. Part of this deal involved title insurance through Stewart Title. It was held that they had to cough up the defence costs.
The insurance company for Ontario lawyers, LAWPRO, requires a $50-levy on all real estate transactions. This is to defray the costs involved in dealing with fraud claims which are on the rise. However, LAWPRO exempts from the levy transactions that used approved real estate title insurance, like Stewart Title. To become "approved", Stewart agreed to provide an indemnity in favor of Ontario lawyers and firms facing claims. Stewart refused to pay the costs of defending Gavin's client, the lawyer, arguing that it was only required to indemnify if there was a damages or cost award.
The Court disagreed, and ruled that Stewart Title had to fund the ongoing defence costs of lawyers who use Stewart Title insurance in their deals.

03/27/2009— Multi-Million Dollar Green Initiative Completed
A multi-million dollar green initiative involving approximately 10 acres of land in the centre of Toronto, with funding from all three levels of government, has recently been completed, with Gardiner Roberts LLP representing the owner of the lands, Toronto and Region Conservation Authority (“TRCA”). The complex transaction involved funding in the $35,000,000 range and protection and development of heritage, cultural, community and ecological features. Participants in the development include Evergreen, the charity developing the project, TRCA, the City of Toronto, and the governments of Ontario and Canada. The team of Robert Rossow and Lori Mark of Gardiner Roberts LLP represented TRCA in the many phases of the transaction."
